EEM on behalf of its members are looking to appoint an independent specialist elevator, escalator and access equipment consultancy service provider, who will provide a consultancy service to include; Maintenance Management Services, Surveys and Condition Reports, Project Management , CDM and Expert Witness Duties, allowing EEM members to utilise their services as necessary via the framework. EEM members are predominantly within the East Midlands but not exclusively so and may have requirements in other parts of England and W
ales. The consortia is owned by our members which include Housing Associations, ALMO's, Local Authorities and bodies from the wider public sector including hospitals, universities and the police. A full list of current EEM members is provided in Annex A.

This Contract Notice has been published by Efficiency East Midlands Limited (`EEM┐) on behalf of theirmembers and the other organisations described below as being Authorised Users. EEM is incorporated ascompanies limited by guarantee. The Framework Agreements being procured by the procurement exercisebegun by publication of this Contract Notice will be entered by EEM as the Contracting Authorities which willhave undertaken and completed that procurement exercise. Any reference in this Contract Notice to ContractingAuthority is deemed to be and include a reference to EEM.
The current members of EEM are detailed in Annexe A. All of the current members are to be regarded asContracting Authorities under the Public Contracts Regulations 2015 for the purpose of the procurementexercise begun by publication of this Contract Notice and Authorised Users entitled to access and use theFramework Agreements to be awarded at conclusion of the procurement exercise begun by publication of thisContract Notice.
The Authorised Users of the Framework Agreements being advertised by this Contract Notice and entitled toaccess and use the Framework Agreements to be awarded at conclusion of the procurement exercise begun bypublication of this Contract Notice are:
1 Any current EEM Member ┐ being an organisation which is a member of EEM at the date of this ContractNotice and being one of the organisations identified in Annex A; and
2 Any Future Member of EEM ┐ being an organisation which has applied to join and has joined EEM as amember in accordance with the constitutional documents of EEM and in respect of which such organisationnotice has been given to the economic operators that are a party to the Framework Agreements awarded atconclusion of the procurement exercise begun by publication of this Contract Notice that such organisationis an Authorised User. Future EEM Members may include consortia made up of organisations which wouldthemselves individually be a Future EEM Member and may include any special purpose vehicle (of whatevernature) owned and controlled by the consortia members and would include in those circumstances the individualconsortia members of the special purpose vehicle that own and control that special purpose vehicle; and
3 An EEM Participant ┐ being an organisation based within England or Wales which is neither a currentEEM Member (as defined at 1 above) nor a Future Member of EEM (as defined at 2 above) but in all casesis a contracting authority under the Public Contracts Regulations 2015 and which owns and/or maintains/manages housing stock in one or more geographic area in which it operates and is a local authority i.e.. aCounty, Metropolitan (City), District or Borough Council or a Unitary Authority in England or Wales or is anArm's Length Management Organisation (`ALMO┐) or any statutory replacement or successor organisationmanaged by such local authority under a management agreement under section 27 of the Housing Act 1985(or subsequent legislation) or is a provider of social housing registered as a registered provider with theHomes and Communities Agency or as a registered social landlord with the Welsh Ministers or (in the caseof EEM) is an NHS Trust (which includes Acute Trusts, Mental Trusts, Care Services Trusts and AmbulanceTrusts) or organisation, police authority, fire authority, ambulance trust, university, higher education or furthereducation college or other public sector organisation and in all cases in respect of any such contracting authorityorganisation notice has been given by EEM to the economic operators that are a party to the FrameworkAgreements awarded at conclusion of the procurement exercise being advertised by this Contract Notice thatsuch organisation is an Authorised User of the Framework Agreements, EEM Participants may include consortia made up of organisations which would themselves individually be an EEM Participant and may include anyspecial purpose vehicle (of whatever nature) owned and controlled by the consortia members and would includein those circumstances the individual consortia members of that special purpose vehicle that own and controlthat special purpose vehicle.

Reference to legislation in this Contract Notice includes successor and/or replacement legislation. EEMreserves the right not to award any Framework Agreements at the end of the procurement exercise begun bypublication of this Contract Notice or to award only part of parts of the proposed works and reserves the right notto award any one or more Lot.
The Authorised Users will have requirements predominantly within the East Midlands but not exclusively so andmay in the future have requirements in other parts of England and Wales. Authorised Users in other parts ofEngland and Wales may also access and use the Framework Agreements to be awarded at conclusion of theprocurement exercise begun by publication of this Contract Notice. The successful economic operators maytherefore expect the Framework Agreements to be awarded at conclusion of this procurement exercise to beoperated and implemented throughout England and Wales.
EEM operates a range of existing supply chain arrangements with which successful economic operators willneed to interface. Framework Agreements may be awarded on a multi client as well as a single client basis withthe facility for Authorised Users to join both.
Organisations expressing interest and receiving PQQ documents should be aware that TUPE legislation mayapply to the arrangements which are being advertised by this Contract Notice; EEM for themselves and allAuthorised Users express no view or opinion about whether TUPE legislation will or will not apply and allorganisations expressing interest in response to publication of this Contract Notice and selected to be invited totender must take their own legal and other relevant advice at all Stages.
EEM reserve the right to amend the procurement documents prior to issuing the ITT for whatever reason and inresponse to comments and observations received from interested economic operators.
The Call Off Contracts to be awarded pursuant to the Framework Agreements to be entered at conclusion of theprocurement exercise begun by publication of this Contract Notice may extend for a duration of up to two yearsbeyond expiry of the four year term of the Framework Agreements.
